Neff Injury Law Obtains $1,364,000 Verdict In Deck Railing Failure Case

On April 20, 2022, Neff Injury Law obtained a $1,364,000 verdict for a man seriously injured in a fall at a rental home when a deck railing gave way.  Despite a court directed mediation and a later judicial settlement conference, the Defendant never made an offer to settle the case.

A Fayette County, Georgia jury returned the verdict after an eight-day trial that was spread over three different weeks.

During discovery, Neff Injury Law established that after building the deck railings, the landlord never inspected them. Neff Injury Law also found that after a prior railing failure, the landlord chose only to repair part of the railing system instead of replacing it all.

Landlords have a responsibility to ensure their decks are built according to code. After a deck is built, it should be regularly inspected for water damage and other hazards.
